KOALA HOSTING has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services. Specific Acceptable Use Policies...
There are to be no war, xdcc eggdrops or takeover bots ran here at KOALA HOSTING. You shall not run eggdrop bots on a server that doesn’t allow them. There shall be no denial of service ( DoS )attacks. If you are found using or participating in denial of service attacks you will have your account suspended immediately, pending an investigation by KOALA HOSTING management.

Use of our Servers...
Web sites and shell accounts are to be used by the primary owner only. Customers running CGI or other scripts that use up an unreasonable amount of CPU, memory, or load average will be immediately suspended. Furthermore no customer may use more than 20% of system resources at any give time. Customers are not permitted to resell, store, or give away web hosting services off of their web site to other parties unless otherwised agreed upon in the resellers package. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

Unauthorized Use of Other People's Accounts or Computers...
KOALA HOSTING will strongly react to any use or attempted use of an internet account or computer without the owner's authorization. Such attempts include tricking other people into releasing their passwords, password cracking, security hole scanning, etc. Any unauthorized use of accounts or computers by a KOALA HOSTING customer, whether or not the attacked account or computer belongs to KOALA HOSTING, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, according to the seriousness of the attack.

· Unsolicited E-mail, News Bombing (SPAM) Use of the koala Hosting service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Spam complaints will be sent to the e-mail address on file. Violations of this type will result in the immediate suspension of the offending website on the koala hosting server. Failure to respond to complaints within a 24 hour timeframe will result in the koala hosting abuse staff suspending the offending website or shared hosting account by whatever means necessary. Should the account become re-activated without the express written consent of koala hostings Abuse Department, the offending website or shared hosting account will be immediately terminated, and may result in suspension / termination of the server should the site and/or client re-appear on the server. Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been completely removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation will be immediately and permanently removed from our network without notice. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending koala Hosting account.

Payment Policies...
All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major accounts changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. KOALA HOSTING reserves the right to change prices at any time. Payment is due by the day the account is created and payment is to be recieved before account will be activated.

A 7 day grace period is in force for accounts paying by checque, or direct bank transfer. If payment have not been received at that time the account will be suspended and reactivation fee might apply.

The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies KOALA HOSTING to request termination of services.

To help avoid additional monthly charges we you can have the option of pre-paying via Money Order for one year in advance please contact KOALA HOSTING Billing to make the neccessary arrangements. All payments are made in AU. currency.

Cancellation...
KOALA HOSTING reserves the right to cancel service at any time. KOALA HOSTING can not be held responsible for any lost data, revenue, or business from this act. If cancellation is caused by customers’ violation of these policies, then no refund is due. Customers can cancel service any time but no refund is due.

Domain Names...
Customers may purchase new domain names at the time of account sign-up. It is the sole responsibility of the customer to ensure that the new domain name is available for purchase. If the customer places an order for a new domain name that is not available, that client will be billed the domain name registration fee. The client must contact KOALA HOSTING to purchase a new domain name, to be used instead of the pre-existing domain name.

Unlimited...
KOALA HOSTING offers unlimited email accounts, mailing list, auto-responders, etc. Customers may use as many items of these features as they want, inasmuch as the resources placed on the server by that customer does not exceed 15%. KOALA HOSTING reserves the right to suspend customers using 15% or more of system resources at any given time.

Lawful Purposes...
KOALA HOSTING reserves the right to refuse service to anyone. Customers may only use KOALA HOSTING server for lawful purpose. Transmission of any material in violation of any federal, state or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets. KOALA HOSTING expressly forbids anyone from using KOALA HOSTING servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, illegal warez, programz or any other types of hacking materials and satanic materials. The designation of any materials as such described above is left entirely to the discretion of the KOALA HOSTING management. KOALA HOSTING is intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of KOALA HOSTING resources. Doing so could result in immediate account cancellation.
